Terms of Service
Effective from [date]
The Polish version of this document is legally binding. This English version is a translation provided for convenience.
1. General provisions
1. These Terms of Service set out the rules for using the website at spintour.net and the rules for providing services by electronic means.
2. The Service Provider and owner of the Website is [full entity name], registered at [address], NIP […], REGON […], entered in the [KRS / CEIDG] register under number […], hereinafter the "Provider".
3. Contact: [email address], [phone number].
4. These Terms are made available free of charge in a form that allows them to be downloaded, reproduced and saved.
5. Using the Website constitutes acceptance of these Terms.
2. Definitions
- User — a natural person using the Website.
- Website — the online service available at spintour.net.
- Camp — a tourism event organized by the Provider and presented on the Website.
- Booking — an order placed by a User for participation in a Camp via the Website.
- Terms of Participation — a separate document governing participation in Camps, available on the Website.
3. Services provided by electronic means
1. Via the Website the Provider provides the following services: - browsing content — providing information about Camps, prices and dates, - contact form and group enquiry — enabling contact with the Provider, - online booking — entering into a contract for participation in a Camp, - newsletter — sending information about new dates, based on separate consent, - waiting list — notification of a spot becoming available or new dates opening.
2. The content-browsing, contact form, newsletter and waiting list services are free of charge.
3. The contract for the provision of services by electronic means is concluded when the User starts using the relevant service and terminates when they stop using it, and in the case of the newsletter, when they unsubscribe.
4. Technical requirements
1. Using the Website requires: - a device with internet access, - an up-to-date web browser supporting JavaScript and cookies, - an active email account — for services that require contact.
2. The Provider is not liable for problems arising from failure to meet the above requirements or from causes on the part of the User's internet provider.
5. Booking and conclusion of the contract
1. Information about Camps presented on the Website does not constitute an offer within the meaning of the Civil Code, but an invitation to enter into a contract.
2. The booking process includes: - choosing a Camp, package option and additional services, - providing the Participant's details and billing details, - reviewing the Terms of Participation and the standard information form, - paying the deposit.
3. The spot is held while the booking is being completed, for no longer than 15 minutes. After that time the booking expires and the spot returns to the pool.
4. The contract is concluded on the terms set out in the Terms of Participation. In the event of any discrepancy between these Terms and the Terms of Participation, as regards participation in a Camp, the Terms of Participation take precedence.
5. Prices are quoted in euro (EUR) and include tax.
6. Payments
1. Payments are made by bank transfer to the Provider's account. The transfer details for the deposit are sent by email after a booking request is submitted. The Provider does not collect or store payment card details.
2. The transfer reference given in the email must be used so that the payment can be matched to the booking.
3. Invoices are issued in accordance with applicable regulations. The User indicates on the form whether they are purchasing as a private individual or as a business.
7. Right of withdrawal
1. The statutory 14-day right of withdrawal from a distance contract does not apply to contracts for services related to leisure activities, concluded for a specific date or period of performance.
2. Regardless of the above, the Provider applies its own refund policy set out in the Terms of Participation.
3. The User exercises the right of withdrawal from the free electronic services — the newsletter and the waiting list — by unsubscribing at any time.
9. Complaints about the electronic services
1. Complaints about how the Website works should be sent to [email address].
2. The report should describe the issue and include contact details.
3. The Provider deals with the complaint within 14 days of receiving it.
4. Complaints about the course of a Camp are handled on the terms set out in the Terms of Participation.
10. Copyright
1. The content on the Website, in particular the text, photographs, graphics, logo and layout, is protected by copyright and belongs to the Provider or to parties with whom the Provider has entered into the relevant agreements.
2. Using the Website's content beyond permitted personal use requires the Provider's prior written consent.
3. In particular, copying Camp descriptions, photographic material and visual-identity elements is prohibited.
11. Rules for using the Website
1. The User must use the Website in accordance with the law and good practice.
2. It is prohibited to submit unlawful content, to take action that disrupts the Website's operation, or to impersonate other people.
3. The Provider may block a User's access to the Website if they breach the above rules.
12. Personal data and cookies
1. The controller of personal data is the Provider.
2. The detailed rules for processing data and using cookies are set out in the Privacy Policy available on the Website.
13. Final provisions
1. In matters not regulated here, Polish law applies, in particular the Civil Code, the Act on the Provision of Services by Electronic Means, and the Act on Consumer Rights.
2. The Provider may amend these Terms for important reasons, in particular changes in the law or in the scope of services provided. Changes are announced on the Website at least 14 days in advance. Contracts concluded before the change are governed by the Terms as they stood at the time.
3. A User who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including the European Commission's ODR platform.
4. These Terms are effective from [date].
