Booking Terms

1. General provisions
1. The trips are organized by [full entity name], registered at [address], NIP […], REGON […], entered in the [KRS / CEIDG] register under number […], hereinafter the "Organizer".
2. The Organizer is entered in the Register of Tourism Organizers and Entrepreneurs Facilitating the Acquisition of Linked Travel Services under number […], kept by [the Marshal of … Voivodeship].
3. Contact with the Organizer: [email address], [phone number], website spintour.net.
4. These Terms of Participation set out the rules for taking part in the camps and sports trips organized by the Organizer and form an integral part of the contract for participation in the trip.
5. Participant — an adult who has entered into a contract with the Organizer, or on whose behalf the contract was entered into.
6. Trip offer — the description of a specific camp published on the Organizer's website, including the dates, location, programme, scope of services, price and specific conditions. The offer forms an integral part of the contract.
2. Scope of services
1. The scope of services covered by the price is set out in the offer for each specific trip. Depending on the trip, it may include in particular: - coaching sessions led by the coaches named in the offer, - access to the hall and training equipment for the duration stated in the offer, - accommodation in the standard stated in the offer, - meals to the extent stated in the offer, - airport–hotel–airport transfers on the dates stated in the offer, - the accompanying programme and attractions stated in the offer.
2. The flight is not included in the price, unless the offer expressly states otherwise. The Participant arranges their own travel to and from the destination at their own cost.
3. Services not listed in the offer as included in the price are additional services, payable separately.
3. Conclusion of the contract
1. Bookings are made via the booking form on spintour.net, or in another form agreed with the Organizer.
2. Before the contract is concluded, the Organizer provides the Participant with the standard information form and the information required by the Act on Package Travel and Linked Travel Services.
3. The contract is concluded once the deposit is credited to the Organizer's account, following the Organizer's confirmation of the booking.
4. The Participant receives confirmation of the contract by email, together with these Terms and the trip offer.
5. The spot is held while the booking is being completed, for no longer than 15 minutes. After that time the booking expires and the spot returns to the pool.
4. Price and payment
1. Prices are quoted in euro (EUR) and include the services listed in the offer.
2. Payment is made in two parts: - a deposit — 50% of the price, payable when booking, - the balance — the remaining 50%, payable no later than 30 days before the trip starts.
3. For bookings made less than 30 days before the trip starts, the full price is payable in one instalment.
4. If the balance is not paid on time, despite a reminder and an additional deadline of at least 7 days, the Organizer is entitled to withdraw from the contract. In that case § 5(2) applies.
5. The Organizer may raise the price only in the cases and under the conditions set out in the Act, no later than 20 days before the trip starts and by no more than 8% of the price. The Participant is entitled to a corresponding price reduction where applicable.
5. Withdrawal from the contract by the Participant
1. The Participant may withdraw from the contract at any time before the trip starts, by sending a statement by email to [email address].
2. In the event of withdrawal, the Organizer retains the deposit, being 50% of the price. The remaining amount paid is refunded within 14 days of receiving the statement.
3. The Participant may transfer their rights under the contract to another person who meets the conditions for participation, by notifying the Organizer no later than 7 days before the trip starts. The Participant and the person taking over the booking are jointly and severally liable for payment of the price and any reasonable costs of the transfer.
4. The Participant may withdraw from the contract without charge if unavoidable and extraordinary circumstances occur at or near the destination that significantly affect the trip.
5. Refund as a goodwill policy. Regardless of point 2, the Organizer refunds the full amount paid if the withdrawal statement is received within 14 days of the contract being concluded and no later than 30 days before the trip starts.
6. Changes and cancellation of the trip by the Organizer
1. The trip takes place subject to the minimum number of participants stated in the offer being reached. The Organizer notifies Participants of cancellation on these grounds no later than [20/7/48h — depending on the length of the trip] before the start.
2. If the Organizer cancels the trip, the Participant receives a 100% refund of the amount paid within 14 days. The refund does not exclude further claims where these are available under the Act.
3. The Organizer may make minor changes to the programme, in particular to session times, the order of programme elements, the coaching staff, or the training venue, replacing it with one of a comparable standard. The Organizer informs the Participant of such changes clearly and understandably.
4. If a significant change to the main characteristics of the services becomes necessary, the Organizer promptly notifies the Participant, who may either accept the change or withdraw from the contract free of charge and receive a full refund.
7. Liability
1. The Organizer is liable for the proper performance of the services covered by the contract, on the terms set out in the Act on Package Travel.
2. The Organizer provides the Participant with prompt assistance if they get into difficulty during the trip, in particular by providing information on health services and consular assistance, and by helping them use means of distance communication.
3. The limitation of the Organizer's liability to three times the price of the trip applies only to the extent permitted by the Act, and does not apply to personal injury or to damage caused intentionally or through negligence.
8. Participation in the sports sessions, health and level
1. The sessions are sports training of the intensity stated in the offer. The Participant confirms that their state of health allows them to take part in sessions of that intensity.
2. The Organizer states the required skill level in the offer. The Participant chooses a trip that matches their ability. In case of doubt, the Organizer provides information before the contract is concluded and may recommend a different date or trip.
3. The Participant must inform the Organizer of any health circumstances that may be relevant to safe participation in the sessions, in particular any previous injuries.
4. The Participant takes part in the sessions with due care and follows the coaches' instructions.
9. Participant's obligations
1. The Participant is required to: - hold valid travel documents required in the destination country, - comply with the rules of the sports facilities and hotels, - follow the safety rules and the Organizer's instructions, - keep to the trip schedule.
2. The Participant is liable for any damage they culpably cause to the property of the Organizer, the hotel, or the sports facility.
10. Exclusion from the trip
1. The Organizer may exclude a Participant from further participation in the trip in the event of a serious breach of social norms, aggressive behaviour, intentional damage to property, or behaviour endangering the safety of others.
2. Exclusion takes place after a prior warning, unless the nature of the breach makes this impossible.
3. In the event of exclusion, the Participant is not entitled to a refund for unused services, and the cost of the return journey is borne by the Participant.
11. Insurance
1. The Organizer provides Participants with insurance to the extent and with the sums insured stated in the offer for the specific trip.
2. The Organizer recommends taking out additional trip cancellation insurance.
12. Complaints
1. The Participant reports any non-conformity promptly, during the trip, to allow the Organizer to remedy it on the spot. Reports are handled by the Organizer's representative present on the trip.
2. Complaints after the trip has ended should be sent by email to [email address]. The Organizer deals with the complaint within 30 days of receiving it.
3. A Participant who is a consumer may use out-of-court methods of handling complaints and pursuing claims, including the European Commission's ODR platform.
13. Image rights
1. During the trips the Organizer may take photographs and recordings documenting them.
2. The Participant's image is used in promotional materials only on the basis of separate, voluntary consent, given on the booking form or on site. Not giving consent does not affect the ability to take part in the trip or its terms.
3. Consent may be withdrawn at any time. The Organizer removes the material from the channels it manages promptly after being informed of the withdrawal.
14. Personal data
1. The controller of Participants' personal data is the Organizer.
2. Data is processed to conclude and perform the contract, to fulfil legal obligations including tax obligations, and to establish and pursue claims.
3. Data may be shared with parties involved in running the trip, in particular hotels, insurers, carriers and sports facilities, only to the extent necessary.

15. Final provisions
1. In matters not regulated here, Polish law applies, in particular the Act on Package Travel and Linked Travel Services and the Civil Code.
2. Any provision of these Terms less favourable to a consumer Participant than the mandatory statutory provisions is invalid, and the statutory provisions apply in its place.
3. The Organizer may amend these Terms. Changes do not apply to contracts concluded before they take effect.
